United Sportsplex Pickleball Event Waiver of Liability, Assumption of Risk, and Indemnity Agreement

By signing this agreement, I acknowledge and agree to the following terms and conditions for participation in the Pickleball Tournament hosted by United Sportsplex ("Provider").

Acknowledgment of Risks:

I understand that participation in the Pickleball Tournament and any related activities are inherently risky and may involve the risk of injury, death, or property damage. I also recognize that there are both foreseeable and unforeseeable risks of injury or damage that may occur as a result of participating in these activities.

Assumption of Risks:

I voluntarily assume all risks and hazards related to, arising out of, or associated with my participation in the Pickleball Tournament, whether occurring prior to, during, or after the event.

Waiver and Release of Liability:

I hereby release, waive, and discharge United Sportsplex, its owners, officers, directors, employees, volunteers, agents, and representatives ("Releasees") from any and all liability for any harm, injury, death, or property damage of any kind, sustained by me or others, arising from or related to my participation in the Pickleball Tournament. This waiver applies even if the Releasees have acted negligently.

Indemnity:

I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, costs, expenses, damages, lawsuits, and any other liabilities including but not limited to legal fees and disbursements, incurred as a result of my conduct, actions, or omissions during the Pickleball Tournament, or my breach of the terms and conditions of this Agreement.

Parental Consent (For Participants Under 18):

I certify that I am the parent or legal guardian of the minor participant and consent to his/her participation and agree individually and on behalf of the minor to the terms of this waiver.

Protection Against Harassment:

I understand that United Sportsplex has a zero-tolerance policy for any form of harassment, including but not limited to sexual harassment. Any form of harassment is grounds for immediate removal from the event and may lead to legal consequences.

Jurisdiction:

This agreement is governed by the laws of the State of Texas. Any dispute arising out of or relating to this Agreement shall be settled by arbitration in Richmond, Texas.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
